If you need to have a document notarised before it can be considered valid for business or legal purposes, then you need to make an appointment with a notary public. However, how can you find a notary public, and how can you know they are experienced and qualified to perform the function you need?

At Brisbane Notary, we offer notary public services to Newmarket and other Brisbane suburbs. We have been operating in this area since 2015, but our notary public—Peter Tobin—has been a notary for 17 years. With a wealth of experience in both notary work and legal matters, Peter can help you understand why notarisation is important and how notaries work in Australia.

The Notary in Australia: What You Need to Know

In Australia, no one starts out as a notary. On the contrary, public notaries are usually practising lawyers who are appointed by the Archbishop of Canterbury through the Court of Faculties in London. Once a person is appointed as a notary public, that appointment lasts for life. An individual who has been appointed as a notary public in their state or territory has the statutory power to verify identities, witness the signing of legal documents, administer oaths, take statutory declarations and more. These services are often required for business transactions, legal matters (including litigation or prosecution), matters of estate and inheritance and more.

Every notary public in Australia has his or her own unique seal and signature. Each seal is registered with the Department of Foreign Affairs and Trade (DFAT). This point is important, as it gives the notary public the power to verify and certify documents both domestically and internationally. If you meet with a valid public notary in Newmarket, that person will be able to notarise not only documents intended for domestic use but also foreign legal or business documents.

The notary process may vary a bit depending on the document to be notarised. In some cases, the notary public will sign and stamp the document and then it will be ready to be sent to its final recipient. In other cases, the document may need to be notarised and then sent to DFAT for authentication. DFAT can refer to a comprehensive register of Australian notary seals to verify that a document has been legally notarised and is not a form of fraud. In most cases, the document can be sent to its recipient after DFAT authenticates. Occasionally, though, the document will go to the consulate or embassy in the relevant country, where it will be ‘legalised’ before finally reaching the hands of the recipient. You should ask your notary in Newmarket which process will likely be necessary or your document.
